He alleged that his automobile insurance carrier violated Kentucky's Unfair Claims Settlement Practices Act by failing to exercise good faith in evaluating his injuries and damages. The settlement represents the at fault driver's $25,000 policy limits, $40,000 of the Plaintiff's underinsured motorist (UIM) benefits, and $75,000 for his insurer's bad faith.
